Customer data ownership
You own your data. All data you upload, connect, or generate through Atlantic (your knowledge base, documents, conversation history, integration data) remains your intellectual property.
You grant Atlantic a limited, non-exclusive license to process your data solely to provide and operate the service. Atlantic will not use your data to train AI models, share it with third parties except as described in the Privacy Policy and DPA, or retain it beyond the periods disclosed in those documents.
On termination, you may export your data within 30 days. After 90 days, we will permanently delete your data from our systems.
Intellectual property
Atlantic and its licensors own all rights to the Atlantic platform, including the software, design, and brand. These Terms do not grant you any ownership rights in Atlantic’s technology.
AI-generated outputs produced by the platform on your behalf belong to you, subject to applicable law and any restrictions imposed by the underlying model provider.
Feedback or suggestions you provide about the service may be used by Atlantic without obligation or compensation.
Fees & subscriptions
Pricing is as stated on the pricing page or in your order form at the time of purchase. All fees are in USD unless otherwise stated.
Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time; cancellation takes effect at the end of the current paid period. No refunds are issued for partial periods unless required by law.
We may adjust pricing with 60 days’ notice. Price changes do not affect your current billing period.
Enterprise customers are subject to the pricing and payment terms in their order form, which supersede this section.
Warranties & disclaimers
Atlantic warrants that it will operate the service with reasonable skill and care and in material conformance with its documentation.
Except as stated above, the service is provided “as is” and “as available”. To the maximum extent permitted by law, Atlantic disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
AI-generated outputs may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and validating outputs before acting on them.
Limitation of liability
In no event will Atlantic be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits or data), even if advised of the possibility of such damages.
Atlantic’s total cumulative liability arising out of or related to these Terms will not exceed the greater of (a) the fees paid by you in the 12 months preceding the claim, or (b) $100 USD.
These limitations apply to the fullest extent permitted by applicable law. Some jurisdictions do not allow certain limitations; in such cases the above applies only to the extent permitted.
Termination
Either party may terminate this agreement at any time. You may terminate by cancelling your subscription and ceasing use of the service. Atlantic may terminate for cause (material breach not cured within 30 days of notice) or immediately for violations of the Acceptable Use section.
On termination, your access to the service will end. Sections on IP, liability, data ownership, and governing law survive termination.
Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware, and each party consents to personal jurisdiction there.
For customers in the EU or Turkey, nothing in this section limits your rights under applicable consumer protection or data protection law.
Changes
We may update these Terms. We will notify you by email at least 30 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms. The current version is always at getatlantic.ai/terms.
